My Gears 2 is broken!

Well Monday night I went to a Gears 2 party, And it was fun for about the first two hours. Then out of the blue one of my friends brothers shows up (Drunk) and tosses there small dog into my xbox tipping it over and braking my gears. WTF! The drunk kid (19) refuses to buy me a new game because he says I was irresponsible for leaving my xbox up right. Now I have to trade in 3 of my games and Gears 2 just to get a new one. Am I out of line for asking him to pay me back?
